4. That Section 9.11.02 of the Ramsey City Code does not permit the construction of accessory <br /> structures nearer the front property line than the principal structure. <br /> <br />5. That the principal structure on the subject property is approximately 90 feet from the front <br /> property line. <br /> <br />6. That the Applicants are proposing to construct a garage approximately 40 feet from the front <br /> property line. <br /> <br />7. That the City Code allows a for a total of 1,664 square feet of garage and accessory buildings <br /> on the subject property; the proposed garage is 624 square feet in size; there are no other <br /> garages or accessory buildings on the property. <br /> <br />8. That there are special conditions applying to the Subject Property that do not generally apply <br /> to other properties in the district; namely the side and rear yards contain sharply declining <br /> topography, wetlands, mature tree growth, drainfield and alternative drainfield. <br /> <br />9. That the special conditions do not result from the actions of the Applicants. <br /> <br />10. That literal interpretation of the provisions of City Code would deprive the Applicants of <br /> fights commonly enjoyed by other properties in the same district, namely the right to have a <br /> garage on the premises. <br /> <br />11. That if granted, the variance will not permit a use that is prohibited in the R-1 Rural <br /> Residential District. <br /> <br />12. That the variance requested is the minimum variance which would alleviate the hardship. <br /> <br />13. That if granted, the variance will not impair an adequate supply of light and air to adjacent <br /> property. <br /> <br />14. That if granted, the variance will not unreasonably increase the congestion in the public <br /> street. <br /> <br />15. That if granted, the variance will not increase the danger of fire or endanger the public safety. <br /> <br />16. That if granted, the variance will not unreasonably diminish property values in the <br /> neighborhood. <br /> <br />17. That if granted, the variance will not violate the intent of the Comprehensive Plan. <br /> <br />18.
