CASE # <br /> <br />REQUEST FOR A VARIANCE TO CONSTRUCT AN ACCESSORY STRUCTURE <br />NEARER THE FRONT PROPERTY LINE THAN THE PRINCIPAL STRUCTURE; <br />CASE OF WARREN HARRINGTON <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />City Code states that accessory structures shall not be constructed nearer the front property line <br />than the principal structure. Warren Harrington is requesting a variance to construct a garage <br />nearer the front property line than the principal structure at 15450 Sunfish Lake Blvd. N.W. The <br />parcel is approximately 2 acres in size, and the house is located approximately 138 feet from the <br />front property line. Mr. Harrington is proposing to construct a garage which will be <br />approximately 127 feet from the front property line. The following items are enclosed for your <br />information: <br /> <br />a) Site location map <br />b) Site plan <br />c) Proposed Findings of Fact <br />d) Proposed Variance <br /> <br />Notification: <br /> <br />In accordance with State Statute, Staff attempted to notify property owners within 350 feet of the <br />subject property of the request for a variance. <br /> <br />Observations: <br /> <br />The site plan submitted and an on-site inspection reveal that declines in topography, mature tree <br />growth, and vehicular access to septic system prohibit construction of a garage in the side or rea~ <br />yard. In Staff's opinion, the mature tree growth in the area and the alignment of neighboring <br />home to the north will have no adverse impact to the neighbors view of the street scape by the <br />construction of this proposed garage. The attached garage is 520 square feet; an existing storage <br />shed is 150 square feet; the proposed garage is 864 square feet; for a total of 1,534 square feet. <br />The total amount of garage space allowed on the property is 2,064 square feet. <br /> <br />Staff Recommendation: <br /> <br />In the opinion of City Staff, the physical features on Mr. Harrington's property justify the <br />granting of a variance. City Staff recommends approval of the variance. <br /> <br /> <br />
