CASE/41 <br /> <br />RECEIVE DEVELOPERS COMMENT ON <br />PROPOSED TRAIL/SIDEWALK ORDINANCE <br />By: Mark Boos, Parks/Utilities Supervisor <br /> <br />Background: <br /> <br />The purpose of this case is to invite public comment on the proposed sidewalk/trail ordinance <br />that has been discussed by the Commission for the past few months. (As you'll recall, at <br />January's regular meeting, the commission recommended apProval of a sidewalk/trail resolution. <br />Staff is recommending that this matter be addressed by ordinance, as it will then be referred to in <br />the subdivision ordinance of City Code.) On Tuesday, February 1, 2000,-the Planning <br />Commission recommended the language below: <br /> <br />"All subdivisions within the urban service area shall have a minimum eight-foot. (8') wide <br />bituminous or concrete trail or sidewalk paralleling each street to provide for effective snow <br />removal and safe two-way pedestrian traffic. The only urban subdivision streets that may not be <br />required to have these trails are residenti:f. cul-de-sacs with no probability as a through street. <br />The trail shall be constructed as a Stage I improvement. The cost will be borne by the developer <br />and not eligible for credit against park and trail dedication fees. The design must meet current <br />standards of the City, comply with the ADA act and be shown on the preliminary plat for <br />approval." <br /> <br />This is different from what the Park and Recreation Commission reviewed only in that it states <br />that cul-de-sacs will not receive the sidewalks, regardless of the number of units on that street. It <br />is important to note that the above draft language is permissive relating to cul-de-sacs. For <br />instance, if there was a destination on that dead-end street, (i.e., trail, park, retail center, or <br />connection to another cul-de-sac) then the City may require a walkway on this street too. <br />Enclosed for your information, is a letter sent to developers and those urban residents requesting <br />to be kept informed on trail issues. <br /> <br />The following is a tentative schedule for this proposed ordinance amendment: <br /> <br />· February_ 10, 2000 - Regular Park and Recreation Commission meeting <br /> Commission hosts informational meeting to receive comments from developers and others on <br /> the proposed ordinance. <br />· March 6, 2000 - Regular Planning Commission meeting <br /> Commission holds public hearing. <br />· March 14, 2000- City Council meeting <br /> Council considers ordinance for introduction (first reading). <br />· March 28, 2000 - City Council meeting <br /> Ordinance adoption. <br /> <br /> <br />
