AGREEMENT An agreement related to easements and pipeline installation between the City of Ramsey (City) and Northern Natural Gas Company. (Northern) Whereas, Northern has submitted a request for additional easement rights and temporary easements related to several parcels owned by the City; and Whereas, the City has reviewed the sites and proposes that in addition to the easement agreements and related compensation that Northern agrees to complete the following: General (all sites) · All areas will be restored to the original grade unless agreed to otherwise. · All traces of wheel rut-ting and compaction by equipment will be removed by grading or a shatter tine plow if requested by the City. · Ail non-maintained disturbed areas will be re-seeded in native grasses and forbs with MnDot 20A Southwest Mix. · Any debris or buried junk uncovered shall be removed at the expense of Northern. · Northern or its contractors shall cease work and notify the City if any archeological or biological items o£interest are encountered. Tree relocation staking shall be performed by Northern and approved by the City. · All tree counts and flagging for relocation shall be performed by Northern. · The City shall be notified of entry onto the property 48 hours (business day) prior to equipment arrival. · For trees that can't be moved they shall either be replaced with a similar tree or shall be compensated for at $40 per caliper inch up to 3 inches and $15/inch over 3". Ermine Creek Park · Alt trees excluding elm and boxelder under 3" DBA shall be relocated to the south property line, (including a 5' Scotch pine near the right-of-way of Ermine Blvd.) · Approximately 25, 3'-5' Spruce and Pine trees shall be moved from the Brookview Nursery to the south park line. The trees to be moved will be flagged by the City. · All trees not transplantable in the park will be chipped and those wood chips will be spread around the base of the relocated trees. Unnamed Trail · No action necessary other than requirements identified under General Shawn Acres Park · Two small trees at the northwest corner of the park shall be relocated to any voids on the north tree line. The large ash in the same area may be removed (including stump and roots) at a compensation of $350 or a 3.5 caliper deciduous tree may be planted and staked elsewhere in the park. · All maintained turf area that is disturbed shall be reseed with an approved sunny turf grass mix.
