e The department may not require recertification of an ISTS within two (2) years of its certification date provided the system does not fail or become an imminent public health threat or other cause as deemed appropriate by the department. Sale or Transfer of Property. (a) Co) (c) (d) A certificate of compliance shall be provided by the seller to the buyer at or before the closing. The certificate of compliance shall be completed by an Inspector and shall indicate that the ISTS is in compliance with MN RULES Cl~apter 7080 as amended. In the event that one of the exemptions listed in Subdivision 8.30.04 d 4 and 5 cf this SECTION applL,, the certificate must be signed by both parties to the transaction. The certificate shaI1 be flied with the An¢'.:a County Auditor along with the Certificate of Real Estate Value. A copy of the certificate of compliance shall also be filed with the department.
