PW CASE <br /> <br />DISCUSS DRAINAGE ISSUE AT THE INTERSECTION OF <br />164TM LANE AND CSAH #5 <br /> By: Steven J Jankowski City Engineer <br /> <br />Background: <br /> <br />Several years ago a new home was constructed on a low-lying lot immediately north of the lot on <br />the N.W. corner of 164th Lane and CSAH #5. Construction of the home required the house pad <br />to be filled, but the backyard remained low with no outlet for groundwater or precipitation. This <br />lot was created by metes and bounds description, and there are no drainage easements on the lot. <br />Conflict between this subject lot and the comer lot property owners began last spring when the <br />owner of the subject lot drained his back yard by pumping water toward the front of his lot. <br /> <br />Staff believes this is a situation that needs to be resolved between the individuals involved since <br />none of the water involved drained off of public land. However, the situation is complicated by <br />the fact that the ultimate disposition of the public drainage, south of 164th Lane, is onto private <br />property. The City has no easement for depositing water in this manner. <br /> <br />Recommendation: <br /> <br />Staff recommends that contact be initiated with the property owner onto which the drainage is <br />deposited to obtain their input on finding a solution to transmitting the drainage into the DNR <br />wetland. <br /> <br />Committee Action: <br /> <br />Motion to direct staff to contact property owners from whom an easement is necessary. <br /> <br />Reviewed by: <br /> <br />City Administrator <br />Director of Public Works <br />City Attorney <br /> <br />PW: 04/20/99 <br /> <br /> <br />
