App. 4th 861, 2011 <br />WL 454524 (2d Dist. 2011) <br />CALIFORNIA (02/10/11)—This case addressed the issue of whether <br />county ordinances regulating medical marijuana dispensaries ("MMDs") <br />were pre-empted by state laws governing MMDs and/or in violation of <br />the equal protection clause of the state constitution. <br />The Background/Facts: In California, the "Compassionate Use Act" <br />allows for the "safe and affordable distribution of marijuana to all pa- <br />tients in medical need of marijuana."
