There will be no personnel stationed at the site. No signs will be posted on the tower or equipment building except applicable warning or equipment information signs. The existing site access is sufficient. The site is zoned Business. The property to the north is occupied by the Burlington Railroad, the adjacent properties to the east and west are also zoned Business, and the site is bounded by Hwy. # 10 on the south. The City recently adopted a towers ordinance which established reasonable performance standards for towers and antennas. According to the Federal Telecommunications Act of 1996, cities cannot prohibit or have the effect of prohibiting provisions for personal wireless services. Recommendation: The Applicant has met the application requirements of Ramsey's tower ordinance, with the exception of the rear property line setback for the equipment building. City Staff recommends approval of the request contingent upon the applicant modifying the location of the equipment building or obtaining a variance to the rear yard setback, and confirmation that there are no other structures in the ½ mile search area that will accommodate the applicant's proposal. Commission Action: Motion to recommend that City Council adopt Findings of Fact relating to a request from AirTouch Communications, Inc. for a conditional use permit to construct and operate a cellular telephone base station. Motion to recommend that City Council approve the request for a conditional use permit (contingent upon a site plan modification or obtaining a variance to the rear yard setback requirement and confirmation of the ½ mile search area) and adopt a resolution declaring terms of same. ~or- Motion to recommend that City Council deny the request for a conditional use permit based on the findings of fact.
