· ' CASE <br /> <br />REQUEST FOR A CONDITIONAL USE PERMIT TO ALTER THE LANDSCAPE OF <br />PROPERTY LOCATED IN THE RUM RIVER SCENIC OVERLAY DISTRICT; <br /> CASE OF T.V. RAO <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />On March 19, 1999, the City received an application from T.V. Rao at 14359 Waco Street N.W. <br />to regrade and stabilize the bluff line along the Rum River on his property. The following items <br />are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br />d) <br /> <br />Site location map <br />Five (5) sheet set of plans showing existing conditions and proposed project <br />Proposed fmdings of fact <br />Proposed conditional use permit <br /> <br />Notification: <br /> <br />Public hearing notices were sent to properties in excess of the 350 feet radius required by State <br />law. <br /> <br />Observations: <br /> <br />The subject property is located in the Rum River Scenic Overlay District. Mr. Rao had <br />commenced work to stabilize and prevent further erosion of the river bank on his property, <br />unaware that a conditional use permit is required for this kind of project in the Overlay District. <br />Upon notification by City Staff of the need for a permit, work stopped and Mr. Rao submitted the <br />necessary applications fees and plans. <br /> <br />Mr. Rao states that in the last 10 years, he estimates that they have lost at least 8 feet of riverbank <br />due to erosion. Mr. Rao is proposing to regrade the bluff to a workable slope and stabilize it with <br />the use of rip rap and native plants and grasses. <br /> <br />Recommendation: <br /> <br />City Staff recommends approval of the permit. <br /> <br />Commission Action: <br /> <br />Motion to recommend that City Council adopt Findings of Fact relating to the application from <br />T.V. Rao for a conditional use permit for landscape alterations in the Rum River Scenic River <br />Overlay District. <br /> <br />// <br /> <br /> <br />
