10. <br /> <br />11. <br /> <br />12. <br /> <br />13. <br /> <br />14. <br /> <br />15. <br /> <br />16. <br /> <br />That the Applicant's submittal includes an erosion control plan that includes an erosion <br />blanket and silt fence on the slope to minimize run-off into the Rum River during <br />construction. <br /> <br />That the Applicant's submittal includes a restoration plan that will stabilize the slope, reduce <br />sediment nm-off into the river, and re-establish native plants and grasses in the disturbed <br />area. <br /> <br />That in accordance with City Code, the Applicant's application submittal proposes to <br />perform the landscape alterations in a manner which minimizes earthmoving, erosion, tree <br />clearing, and the destruction of natural amenities. <br /> <br />That the proposed use will/will not be unduly dangerous or otherwise detrimental to persons <br />residing or working in the vicinity of the use or to the public welfare. <br /> <br />That the proposed use will/will not substantially adversely impair the use, enjoyment, or <br />market value of any surrounding property. <br /> <br />That the proposed use will/will not be hazardous or disturbing to existing or future <br />neighboring uses. <br /> <br />That the proposed use will/will not be a substantial improvement to property in the <br />immediate vicinity and to the community as a whole. <br /> <br />That the proposed use will/will not be served adequately by public facilities and services such <br />as highways and streets. <br /> <br />That the proposed use will/will not create excessive additional requirements at public cost for <br />public facilities and services, and it will/will not be detrimental to the economic welfare of <br />the community. <br /> <br />That the proposed use will/will not involve uses, activities, processes, materials, and <br />equipment and conditions of operation that will be detrimental to any persons, property, or <br />the general welfare by reason of excessive production of traffic, noise, smoke, fumes, glare, <br />or odors. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br /> , and upon vote bbing taken thereon, the following voted in favor thereof: <br /> <br />and the following voted against the same: <br /> <br />and the following abstained: <br /> <br />RESOLUTION #97-09-287 <br /> Page 2 of 3 <br /> <br /> <br />
