CASE <br /> <br />REQUEST FOR A CONDITIONAL USE PERMIT TO EXCEED THE TOTAL <br />AMOUNT OF ACCESSORY BUILDING SPACE AND THE SINGLE BUILDING SIZE <br />RESTRICTION ON A PARCEL; CASE OF JEFFREY SIGLER <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />On March 9, 1999, the City received an application from Jeffrey Sigler for a conditional use <br />permit to exceed the total amount of accessory building space and the single building size <br />restrictions on his property at 17151 Baugh Street N.W. The following items are enclosed for <br />your information: <br /> <br />a) <br />b) <br />c) <br />d) <br /> <br />Site location map <br />Site plan and building elevations <br />Proposed findings of fact <br />Proposed conditional use p.e. rmit <br /> <br />Notification: <br /> <br />State statute requires notification of the public hearing to owners of property within 350 feet of <br />the subject property. Staff notified property owners within 600 feet of the property. <br /> <br />Observations: <br /> <br />Jeffrey raises horses and likes to ride year around. He is proposing to co~a-uct a 5,100 square <br />foot indoor riding arena. His property is I0 acres in size and City Code allows a total of 5,264 <br />square feet of garage and accessory building space on the property; and no single building should <br />exceed 4,400 square feet in size. He currently has a 1,104 square foot attached garage and a <br />1,200 square foot stable, for a total of 2,304 square feet of accessory building space. This leaves <br />him with a remaining accessory structure allotment of 2,960 square feet. His proposal for an <br />indoor riding arena is a 2,140 square foot overage in the total amount of accessory structure <br />space allowed on the property and a 700 square foot overage in the single building size <br />restriction. <br /> <br />The City has approved two similar requests in the past: one was a 26,395 overall overage and <br />the other was a 10,700 square foot overage.. <br /> <br />The exterior facing finish on the structure is colored metal panels to match the home. <br /> <br />The property is located in the Rural Service Area where there is currently a density zoning <br />restriction of 4 units per 40 acres. However, if the draft Comprehensive Plan is approved by <br />Metro Council, Mr. Landowski's property is one of those areas that will be shifted from 4 units <br />in 40 acres to 1 unit per 2.5 acres, which is still quite rural in character. <br /> <br /> <br />
