The property owner applied for and <br />received a 5-foot variance from the side yard setback for another metal building <br />expansion in 1982. However, the variances did not account for the road right-of-way <br />easement on the north 33 feet that was recorded sometime prior to 1978. <br /> <br />If the easement is not vacated, there would be many building setback issues to address. <br />With road construction along the existing road right-of-way, Waltek would lose the <br />existing gravel driveway. Waltek would need to remove the existing metal building for <br />which it received a variance in 1980, as it is in the road right-of-way easement. Also, the <br />building would for all practical purposes front the new road to the north rather than <br />Sunfish Lake Boulevard as the plan indicates. Thus the entire principal building would <br />significantly encroach upon the 35-foot front yard setback required by City Code. <br /> <br />The 20-foot separation between the proposed expansion and the existing metal accessory <br />building meets the Fire Chief's need for access to the front of the building. <br /> <br />Screening: This property is surrounded by industrial zoned properties on the north, south <br />and west. There is a residential subdivision to the east across Sunfish Lake Boulevard <br />NW. No screening is required where industrial property is surrounded by industrial <br />property, and the City Code regarding non-residential performance standards states that <br />screening need not be provided where the use is across the Street and the front of the non- <br />commercial property faces the residential use. <br /> <br />Landscaping: The Landscape Plan dated 02/12/99 is generally acceptable with the <br />following conditions or amendments. The proposed Landscaping Plan will need to be <br />altered to fit the new site plan. The same number and species of trees and the same <br />general locations should be followed in the revised Landscape Plans. Also, City Staff is <br />somewhat concerned about planting trees within the pipeline easement. All trees that are <br />planted within this easement should be at least 5 feet away from the pipeline, unless the <br />pipeline is to be permanently abandoned. Staff would like to see some additional <br />deciduous tree plantings along the south and east of the proposed access easement. These <br />deciduous trees must be a minimum of 1-inch caliper with a 15 to 30-foot spacing. Staff <br />recommends Oak, Hackberry or other drought tolerant species. <br /> <br />Waste Storage: The plan does not indicate the waste storage location. If the dumpster is <br />to be locate outside, the site plan must indicate the intended location. City Code requires <br /> <br /> <br />
