CASE # 4 <br /> <br />REQUEST FOR SKETCH PLAN REVIEW OF DANNER ADDITION; <br />CASE OF RONALD DANNER <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />Ron Danner is requesting sketch plan approval of a minor subdivision to plat his 27 acre <br />parcel into one lot and one outlot. The following items are enclosed for your <br />information: <br /> <br />a) <br />b) <br />c) <br /> <br />Site location map <br />Sketch plan <br />City Staff review letter dated April 28, 1999 <br /> <br />Observations: <br /> <br />Mr. Danner's intentions are to plat the homestead onto a smaller parcel and sell it. The <br />property is in the Rum River Scenic River Overlay District and the homestead is adjacent <br />to the River. The minimum lot size for riparian lots in the Scenic River District is 4 <br />acres. Lot 1 is proposed to be 4 acres in size and the remaining 23. acres will be platted as <br />outlot for possible future development. This one lot plat will also be in compliance with <br />the 4 units in 40 acres density restriction. <br /> <br />Lot 1 complies with the 300 foot lot width requirement at the building setback line and <br />the ordinary high water level. The current structure setback from the ordinary high water <br />mark is 200 feet. The sketch plan shows that the house is currently located only 102 feet <br />from the river shoreline; therefore, it can be assumed that the house does not meet the <br />required setback from ordinary high water mark either. The platting process cannot <br />remedy that situation and the house will continue to be considered lawful non- <br />conforming. <br /> <br />The homestead currently has and will continue to have access to Erkium Street to the <br />north via a private easement. The sketch plan shows how Lot 1 can be served by a public <br />road at some point in the furore in approximately the same location as the current private <br />easement. Any future resubdivision of the Outlot will require construction of a public <br />road into the property. <br /> <br />The City Code requires submittal of a resubdivision plan to urban densities. The subject <br />property is not anticipated to be included in the Metropolitan Urban Service Area within <br />the next 20 years, so staff has requested a resubdivision plan that would comply with the <br />Scenic River Regulations if the 4 units in 40 acres density restriction is abolished. <br /> <br /> <br />
