Councilmember introduced the following resolution and moved for its adoption: RESOLUTION NO. 99-06- A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT BASED ON FINDINGS OF FACT # AND DECLARING TERMS OF PERMIT FOR PRIVATE DOG KENNEL TO MAINTAIN MORE THAN TWO DOGS ON A PARCEL OF LAND. WHEREAS, the Ramsey City Council adopted Resolution No. 99-06~ adopting Findings of Fact # for this use and herein approves the Conditional Use Permit subject to the following conditions. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: On , 1999, a Conditional Use Permit ("Permit") was issued by the City of Ramsey ("City") to Robert and Rita Knoll ("Perm!.ttee") for a private dog kennel to maintain more than two adult dogs on the property generally known as 6020 151" Lane N.W. and legally described as follows: Lot 2, Block 2, Fox Knoll, Anoka County, Minneso/a ("Subject Property"). This Permit is issued pursuant to Section 9.03.04 of the Ramsey City Code. The conditions of this Permit are as follows: t. This Permit shall remain in effect so long as the conditions imposed herein are complied 2. This Permit shall allow for the maintenance of a maximum of four (4) adult dogs on the Subject Property and adult is defined as any dog over three (3) months of age. 3. That the dogs shall be kenneled indoors and the use of an outdoor kennel is prohibited any time there are more than 2 dogs being maintained on the property. Upon confirmation of any complaints of odor or noise problems relating to the dogs, the City may take action to abate the nuisance in accordance with Section 5.09.03 (Dog Regulations), subd. I8 (Dogs Disturbing the Peace), of the Ramsey City Code, attached hereto as Exhibit A. That the outdoor exercise area as depicted on the site plan received by the City on April 27, 1999 shall be maintained in a sanitary condition according to State and local humane standards.
