Couneilmember <br /> <br />introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #99-06- <br /> <br />RESOLUTION APPROVING THE ISSUANCE OF AN ENVIRONMENTAL PERMIT <br />BASED ON FINDINGS OF FACT # AND DECLARING TERMS OF PERMIT TO <br />REGRADE THE BLUFF IN THE CRITICAL AREA AND SCENIC RIVER SECTION <br />OF THE MISSISSIPPI RIVER <br /> <br /> WHEREAS, the Ramsey City Council adopted Resolution No. 99-06- adopting <br />Findings of Fact # for this use and herein approves the Environmental Permit subj eot to the <br />following conditions. <br /> <br />NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />On ~., 1999, an Environmental Permit ("Permit") was issued by the City of Ramsey <br />("City") to Jim and Kathy Weidenbaeh.:.'("Permit Holder") for landscape alterations on the <br />property legally described as follows: <br /> <br />Lot 7, Block 1, Bower's Mississippi Acres 3~ Addition, Anoka County, Minnesota. <br /> <br />(" Subj ect Property:") <br /> <br />This permit is issued pursuant to Section 9.21 (Environmental Protection) and 9.23 (Scenic <br />River) of the Ramsey City Code. The conditions of this permit are as follows: <br /> <br />That the Permit Holder shall engage the services of a professional landscape architect to <br />develop a Landscape Plan, pursuant to transmittals fi:om DNR Area Hydrologist Tom Hovey <br />dated March 16, 1998 and May 27, 1999 attached hereto as Exhibits A and B respectively, to <br />restore the shoreline, rip rap slope and top of bluff with native plants, trees and grasses <br />compatible with the local landscape and climatic conditions. Said Landscape Plan is subject' <br />to the approval of the City and shall be submitted by July 31, 1999. <br /> <br />o <br /> <br />That during the period of development and implementation of an approved landscape plan, <br />temporary ground cover shall be utilized to prevent erosion and trap sediment. The <br />temporary erosion control methods shall be identified on the approved Landscape Plan. <br /> <br />3. The implementation of the Landscape Plan shall be completed by October 1, 1999. <br /> <br />Failure to prepare the Landscape Plan and install the plantings by the dates specified shall be <br />a violation of the Permit and will result in a fine of $500.00/day until the work is completed <br />to the satisfaction of the City. <br /> <br /> <br />
