along said east line 367.87 feet thence southwesterly to a point on said northerly line <br />right-of-way line 111.9 feet northwesterly, as measured along said right-of-way line, from <br />point of beginning, thence southeasterly along said right-of-way line to point of <br />beginning, together with that part of said Lot 7 described as follows: Beginning at the <br />intersection of said northerly right-of-way line with said east line thence northwesterly <br />along said right-of-way line 36.30 feet, thence north parallel with said east line 203.46 <br />feet to point of beginning, thence west parallel with south line of said section 85 feet, <br />thence north parallel with said east line to northerly line of said lot, said northerly Iine <br />also being southerly right-of-way line of Burlington Northern Railroad, thence east along <br />said southerly right-of-way line to a point on a line drawn parallel with and 33 feet west <br />.of said east line, thence south along said parallel line to point of beginning, except road, <br />subject to easement of record; <br /> <br />ali in Anoka County, Minnesota. <br /> <br />("Subject Property") <br /> <br />NOW THEREFOR_E~ BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE DF MINNESOTA that the findings of fact relating <br />to the request are determined to be as follows: <br /> <br />That on May 17, 1999, Dolphin Real Estate Partknership, hereinafter referred to as <br />"Applicant," properly applied for a conditional use permit to exceed the sign size and height <br />restrictions in the B~3 Highway Business District. <br /> <br />o <br /> <br />That the Applicant appeared before the Ramsey Planning Commission for a public hearing <br />pursuant to Section 9.03.04 of the City Code on June I, 1999, and that said public hearing <br />was properly advertised, and that the minutes of said public hearing are hereby incorporated <br />as a part of these findings by reference. <br /> <br />3. That the Subject Property is approximately 3 acres in size. <br /> <br />That the Subject Property and the parcels to the west and east are zoned B-3 Highway <br />Business; the property on the south side of Hwy. #10 is County Park; and the property on the <br />north side of the Burlington railroad tracks is zoned Business Warehouse. <br /> <br />5. That Section 9.12.08, Subd. 1, of the Ramsey City Code states that there shall not be more <br /> than one ground sign and it shall not exceed 100 square feet for each exposed face. <br /> <br />6. That Section 9.12.03, Subd. 3, of the Ramsey City Code states that grounds signs shall not <br /> project higher than 25 feet. <br /> <br />7. That the Applicant is proposing to erect a 35 foot high sign for the new Burger King facility <br /> on the Subject Property that will total 189 square feet in size. <br /> <br />RESOLUTION #99-06- <br /> Page 2 of 4 <br /> <br /> <br />
