CASE # 1 <br /> <br /> AMENDED REQUEST FOR A CONDITIONAL USE PERMIT (CUP) TO EXCEED <br /> SIGN SIZE AND HEIGHT RESTRICTIONS; <br /> CASE OF DOLPHIN REAL ESTATE/BURGER KING <br /> By: Zoning Administrator Sylvia Frolik <br />Background: <br /> <br />In the commercial and industrial districts, the City Code restricts the ground or freestanding sign <br />size to 100 square feet (200 square feet aggregate surface area). Sign heights are restricted to 25 <br />feet from grade to top of sign. In May, Burger King applied for a conditional use permit for a <br />sign that included a 144 square foot franchise logo and a 45 square foot reader board, for a total <br />of 189 square feet. The sign height was proposed to be 35 feet. <br /> <br />Notification: <br /> <br />Because the amended proposal is a decrease from what was originally proposed for Burger <br />King's sign size and height, no notification of the proposed amendment was sent to neighboring <br />property owners. <br /> <br />Observations: <br /> <br />On June 1, 1999, the Planning Commission conducted a public hearing regarding the original <br />request for an 89 square foot overage in sign size and a 10 foot overage in sign height. There <br />were no verbal or written comments submitted. The Planning Commission recommended that <br />the City Council approve the request for a conditional use permit that would limit the business <br />identification portion of the sign to 100 square feet and the reader board to 45 square feet. They <br />also recommended that the sign height be consistent with that of the Holiday Stationstore sign. <br />The Holiday sign permit indicates a height of 23 feet; therefore, it would be recommended that <br />Burger King maintain compliance with the current 25 foot height restriction. <br /> <br />On JuneS, the request and the Planning Commission's recommendations were presented to City <br />Council. At that time, the applicant informed the Council that the Burger King franchise has just <br />released their new sign design. It is a 113 square foot circular sign. The applicant then stated <br />that their request was being amended to the 113 square foot logo sign with a 45 square foot <br />reader board, that would comply with the 25 foot height restriction. <br /> <br />Chairperson Leo Anderson was at the City Council meeting and at his request, the City Council <br />sent the amended application back to the Planning Commission for their review and <br />recommendation.
