Councilmember Hendriksen questioned if they went the 444 process, would the Mississippi <br />district be assessed. <br /> <br />City Attorney Goodrich replied that it is his understanding that the City could develop a sub- <br />district to help defray the cost. <br /> <br />Councilmember Hendriksen stated that there should be one district for crossing the railroad track <br />on the north side of Highway #10 and then a larger district to cover the cost of draining the pond <br />to the river. <br /> <br />City Attorney Goodrich replied that they should be able to accomplish the districts with 444. He <br />stated that the Council should have detailed information as to how 444 would before the <br />applications are approved. <br /> <br />Community Development Director Sherman stated that she was concerned over the 60-day <br />requirement. <br /> <br />Mr. Zitzloff replied that time is becoming an element, but is willing to wait another couple of <br />weeks to resolve the problems. <br /> <br />City Attorney Goodrich stated that he wants to make sure they follow the right legal procedures. <br /> <br />City Engineer Jankowski stated the difference between Mr. Zitzloff taking care of his own <br />drainage problem and planning for the future is upsizing the pipe. <br /> <br />Councilmember Zimmerman questioned if the frontage road is proposed to be placed inthe front <br />or rear of the property. <br /> <br />Mr. Zitzloffreplied that he moved the whole project back based on the recommendation of Staff <br />to allow for a frontage road along highway #10. <br /> <br />Community Development Director Sherman explained that in this section along Highway #10 it <br />made more sense to place the frontage road in front of the property. <br /> <br />Councilmember Zilnmennan questioned the access from Highway #10. <br /> <br />Community Development Director Sherman replied that the Planning Commission discussed the <br />issue and the plan was sent to MnDOT, but no response has been received as of yet. <br /> <br />Motion by Councilmember Anderson, seconded by Councilmember Hendriksen, to table the item <br />until the next Council meeting at which time City Attorney Goodrich will provide inforn~ation on <br />Minnesota Statue 444. <br /> <br />City Council/September 28, 1999 <br /> Page 18 of 26 <br /> <br /> <br />
