CASE # /

REQUEST FOR A CONDITIONAL USE PERMIT FOR A PRIVATE DOG KENNEL TO
MAINTAIN MORE THAN TWO ADULT DOGS ON A PARCEL;
CASE OF DENNIS AND BONITA COBEY
By: Zoning Administrator Sylvia Frolik

Background:

On October 18, 1999, the City received an application from Dennis and Bonita Cobey for a
private kennel conditional use permit to maintain a maximum of four adult dogs on the property
at 9340 Highway #10 N.W. The following items are enclosed for your information:

a)
b)
c)
c)
d)

Site location map;
Site plan;
Resolution #99-05-094 for a commercial cattery at the site;
Proposed findings of fact;
Proposed conditional use permit.

Notification:

In accordance with State Statute, staff attempted to notify all property owners within 350 feet of
the subject property of the request.

Observations:

The subject property is zoned B-1 Business but is subject to residential zoning regulations
because the principal use of the property is residential. The adjacent property to the east is State
Wayside Park and the property to the west and on the north side of Hwy. #10 is also zoned B-1
Business. The subject property is approximately 4 acres in size. Dennis and Bonita Cobey
currently have 1 Mastiff, 2 Chows and 1 Shit-zu. Because the property is so isolated and
adjacent to Wayside Park, they desire this number of dogs for protection and security purposes.
The Council granted the Cobey's a home occupational commercial permit for a cattery in May.
However, they have stated that they do not intend to conduct any commercial activities such as
breeding, selling, training or boarding of dogs.

Recommendation:

The City Staff recommends approval of the request.
