CASE # / <br /> <br />REQUEST FOR A CONDITIONAL USE PERMIT FOR A PRIVATE DOG KENNEL TO <br />MAINTAIN MORE THAN TWO ADULT DOGS ON A PARCEL; <br /> CASE OF DENNIS AND BONITA COBEY <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />On October 18, 1999, the City received an application from Dennis and Bonita Cobey for a <br />private kennel conditional use permit to maintain a maximum of four adult dogs on the property <br />at 9340 Highway #10 N.W. The following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br />c) <br />d) <br /> <br />Site location map; <br />Site plan; <br />Resolution #99-05-094 for a commercial cattery at the site; <br />Proposed findings of fact; <br />Proposed conditional use permit. <br /> <br />Notification: <br /> <br />In accordance with State Statute, staff attempted to notify all property owners within 350 feet of <br />the subject property of the request. <br /> <br />Observations: <br /> <br />The subject property is zoned B-1 Business but is subject to residential zoning regulations <br />because the principal use of the property is residential. The adjacent property to the east is State <br />Wayside Park and the property to the west and on the north side of Hwy. #10 is also zoned B-1 <br />Business. The subject property is approximately 4 acres in size. Dennis and Bonita Cobey <br />currently have 1 Mastiff, 2 Chows and 1 Shit-zu. Because the property is so isolated and <br />adjacent to Wayside Park, they desire this number of dogs for protection and security purposes. <br />The Council granted the Cobey's a home occupational commercial permit for a cattery in May. <br />However, they have stated that they do not intend to conduct any commercial activities such as <br />breeding, selling, training or boarding of dogs. <br /> <br />Recommendation: <br /> <br />The City Staff recommends approval of the request. <br /> <br /> <br />
