CASE # <br /> <br /> REQUEST FOR AN INTERIM USE PERMIT <br />TO MAINTAIN TWO DWELLINGS ON ONE PARCEL; <br />CASE OF SCOTT ,.AND CARRI EDGERON <br /> By: Sylvia Frolik, Community Development Director <br /> <br />Background: <br /> <br />City Code states that there shall not be more than one main building on a lot unless otherwise <br />provided for in City Code. Mr. and Mrs. Edgerton have purchased the property at 7031 173rd <br />Avenue N.W. The home on the property was constructed in the very early 1900's and the <br />Edgerton s are proposing to demolish the home and construct a new home on the property. They <br />would like to live in the existing home while the new one is being constructed. For a temporary <br />period o~' time, there will be two homes on the property and the Edgerton's have applied for an <br />interim use permit to allow this to happen while the new home is being constructed. <br /> <br />The fbllowing items are enclosed fbr your information: <br /> <br />a) <br />b) <br />c) <br />d) <br />e) <br /> <br />Site location map <br />Site Plan <br />New home floor plan <br />Proposed findings of fact <br />Proposed conditional use permit <br /> <br />Notification: <br /> <br />In accordance with State statute, City Staff attempted to notify all owners ofproperty wirh/n 350 <br />feet of the Subject Property of the request for Interim Use Permit and public hearing. <br /> <br />O bservatio ns: <br /> <br />The Subject Property is approximately 5 acres in size and is located in the Rural Preserve area of <br />the R-1 Residential District. The Applicants are.proposing to live in the existing home on the <br />property while their new home is being constructed. The Applicants have stated that the home <br />has been inspected and no asbestos was found, lead paint levels were in an acceptable range, and <br />the contractor will be disposing of the mercury switch on the thermostat in accordance with <br />Minnesota Pollution Control Agency (MPCA) regulations. <br /> <br />The proposed permit is drafted to require that the new home be constructed within 6 months, that <br />the applicants take occupancy of the new home within 30 days of issuance of certificate of <br />occupancy, and the existing home be demolished and removed wittfin 60 days of the issuance of <br />certificate of occupancy fbr the new home. In the event the weather conditions are not conducive <br />to backfilling the previous house foundation and septic system, the Building Official will have <br />the authority to grant a maximum 60 day extension. Any extensions required beyond that time <br />f¥ame must be approved by the City Council. <br /> <br /> <br />
