ORDINANCE #03-38 <br /> <br />CITY OF RAMSEY <br />ANOKA COUNTY <br />STATE OF MINNESOTA <br /> <br />AN AMENDM, ENT TO CHAPTER 9 WHICH IS KNOWN AS THE ZONING <br />AND SUBDIV~ISION OF LAND CHAPTER OF THE CITY CODE OF RAMSEY, <br />MINNESOTA, <br /> <br />AN ORDINANCE AMENDING SECTION 9.50 "SOLID WASTE" OF CHAPTER <br />9 OF THE cITY CODE OF RAMSEY, MINNESOTA. <br /> <br />The City of Ramsey ordains: <br /> <br />SECTION 1. f, kMENDMENT <br /> <br />Subsection 9.14.04 is amended to read as follows: <br /> <br />9.14.04 Term of Permits. The permit shall be subject to annual review for <br />conformance with this City Code and performance of the permit holder. The Council <br />may also require a performance bond, cash escrow, letter of credit or other financial <br />assurance fromm the landowner or operator to guarantee conformance with these <br />regulations. All property owners and residents within 1,000 feet of the site shall be <br />notified of the annual conditionals use permit review. <br /> <br />The following iubsection is added: <br /> <br />9.14.13 <br /> <br />Mixed Solid Waste and Recycling Transfer Facilities. <br /> <br />Use Restriction. The following regulations shall be observed by any <br />person applying for a conditional use permit or to whom a permit is <br />issued by the City for the construction and operation of a mixed solid <br />waste and recycling transfer facility. These regulations shall govern <br />the construction and operation of all waste disposal facilities and any <br />failure to observe these regulations shall be sufficient grounds for the <br />denial or revocation of the permit by the Council. <br /> <br />1. The rules established by the Minnesota Pollution Control Agency <br /> relating to Solid Waste (SR 7035) must be strictly adhered. <br /> <br />2. All transfer activities shall occur in an enclosed building. <br /> <br />3. Enclosed buildings shall be at least 350 feet from property zoned <br /> or used for residential or park purposes. <br /> <br />9-114 <br /> <br /> <br />
