o <br /> <br />Grading and utility plans, which may affect or impact the proposed <br />park dedication, shall be reviewed and approved by the City <br />Engineer prior to dedication, or at such time as is reasonably <br />determined. <br /> <br />o <br /> <br />To be eligible for park dedication credit, any land to be dedicated as <br />a requirement of this Section shall be useable, developable land <br />recreation purposes and shall be at a location convenient to the <br />people to be served. For purposes of park land dedication, wetlands <br />are not eligible. <br /> <br />o <br /> <br />The Subdivider shall provide the City with a reproduction of the <br />certificate of survey that shows all features as accepted on the final <br />grading plans. Such plan shall be received prior to 9.50.30 <br />maintenance guarantees. <br /> <br />Cash Payment. In lieu of land dedication, the Council may require the <br />subdivider to contribute a cash payment. The value of such payment shall <br />be the amount established by a fee schedule passed by City Council <br />resolution. <br /> <br />If, at the option of the Council it is determined that a cash dedication shall <br />be made, the City shall allocate said cash contribution as follows: 50% of <br />the total cash contribution in the respective Recreation District fund and <br />50% in the Park Improvement Trust Fund. <br /> <br />Exemptions from Cash Payment Requirements. In instances where park <br />dedication is required to be satisfied with a cash payment, any existing <br />developed lot within the boundaries of the plat is exempt from any cash <br />payment due on the plat. In the case of Administrative Subdivisions, the <br />subdivider shall be exempt from complying with any 1--9.50.30 <br />requirements of this Section. <br /> <br />Combination of Land Dedication and Cash Payment. In appropriate <br />subdivisions, a combination of land and cash may be required by the <br />Council. In the event a combination of land and cash is required, the <br />amount of land to be dedicated shall be credited against the total park <br />dedication requirement and the remaining cash contribution shall be based <br />on the percent of the remaining unfulfilled park dedication obligation. <br /> <br />Scenic and Conservation Easements. In appropriate subdivisions, as <br />determined by agreement between the Council and the subdivider, the <br />subdivider may dedicate to the public a scenic easement in combination with <br />the requirements of {}9.50.37 Subd. 2 and 3 above or, if the subdivider and <br />Council agree, the scenic and conservation easement dedication may be in <br />lieu of up to 25% of the requirements in this section. <br /> <br />9.50 Subdivision ~egulations <br /> <br />9-33 <br /> <br />August 2003 Draft <br /> <br /> <br />
