CASE <br /> <br />REQUEST FOR FINAL PLAT APPROVAL OF RADEMACHER ADDITION; <br />CASE OF RADEMACHER COMPANIES, INC. <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />Rademacher Companies, Inc. is requesting final plat approval to split their parcel in the southeast <br />quadrant of the intersection of T.H. #47 and 153rd Avenue NW They plan to develop a <br />convenience store on Lot I and hold Outlot A for future development. <br /> <br />a) <br />b) <br />c) <br />d) <br />e) <br />f) <br />g) <br /> <br />Site location map <br />Proposed fiinal plat <br />Park Commission meeting minutes dated September 11, 1997 <br />Planning Commission meeting minutes dated October 7, 1997 <br />City Staff Review Letter dated January 5, 1998 <br />PrOposed resolution for final plat approval <br />Proposed development agreement <br /> <br />Notification: <br /> <br />The lot split is a minor subdivision for which no notification to adjoining property owners is <br />required. <br /> <br />Observations: <br /> <br />The subject property is currently zoned a combination of B-2 Business and R-3 Urban Residential. <br />There is a small remnant of property in the northwest comer of Outlot A that is still zoned B-1 <br />Business. The Council adopted findings of fact and introduced an ordinance to rezone this remant <br />to R-3 Urban Residential like the rest of Outlot A. However, that rezoning ordinance cannot be <br />finally adopted until the development moratorium is lifted. <br /> <br />Both of the proposed lots meet the minimum size and width requirements for the commercial and <br />multi-family districts. The property is approximately 8 acres in size and they are proposing that the <br />commercial lot will be 3 acres and the multi-family parcel wilt be 5 acres in size. <br /> <br />The plat was reviewed by the Park Commission on September 1 I, 1997 and they recommended a <br />cash payment to satisfy park dedication requirements. <br /> <br />The continuance of the pedestrian path along the east side of T.H. #47 will be required along the <br />west boundary of Lot 1. <br /> <br />With the exception of a temporary right-in only at the common boundary of Lot 1 and Outlot A, <br />right-of-access along T.H. #47 is proposed to be dedicated to the State. The development agreement <br />will require the developer to transfer the access fights for the temporary right-in to the State at the <br />time 153rd is signalized. <br /> <br /> <br />
