CASE <br /> <br />REQUEST FOR FINAL PLAT APPROVAL OF <br />ANOKA IND. GRAIN & FEED ADDITION; <br />CASE OF DAVID PETERSEN <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />David Petersen is requesting final plat approval to subdivide his commercial property on Hwy. <br />#10 into three lots. Lano Equipment plans to purchase what is shoWn as Lot 1 and transfer their <br />business to that site. The following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br />d) <br />e) <br />0 <br /> <br />Site location map <br />Proposed final plat <br />City Staff review letter dated February 20, I998 <br />Planning Commission meeting minutes dated February 3, 1998 <br />Proposed resolution for final plat approval <br />Proposed development agreement <br /> <br />Notification: <br /> <br />No public notification is required for the minor subdivision to subdivide the subject property. <br /> <br />Observations: <br /> <br />The property is approximately 5.9 acres in size. The alignment of the new property lines are <br />such that existing buildings on the property will meet the side yard setback from the new <br />common property lines. All 3 of the lots meet the 1/2 acre minimum lot size, 100 foo~ minimum <br />lot width and 150 foot minimum lot depth requirements in the B-3 Highway Business District. <br />The plat proposes that all 3 of the lots will have access to Hwy. #10 via two existing accesses. <br />This will require private cross easements between the parcels for ingress/egress purposes. <br /> <br />The plan has been forwarded to Mn/DOT for review and comment. It is anticipated that they <br />will require, at a minimum, dedication of the remaining right of access along Hwy. #10. At the <br />sketch plan review stage, one of the Planning Commissioner's recommended that the City <br />require the equalization of the front property line adjacent to Hwy. #10 which would create a 15 <br />foot wide outlot along the eastern half of the plat. This outlot should then be dedicated to the <br />City for future use in resolution of access issues if and when Mn/DOT closes accesses onto Hwy. <br />#10. Staff advises that any firm recommendation relating to Hwy. #10 be reserved until after <br />Mn/DOT's review comments are received. <br /> <br />With respect to zoning regulations, the plat is an improvement to the property. There are several <br />buildings on the property and historically, there has been more than one principal use on the <br />property at any given time. This plat will separate some of the buildings onto separate lots of <br />record to legally accommodate 3 principal uses in the same area. However, there is one septic <br />system and well for all of the principal buildings on the subject property and the development <br />agreement will require verification of cross easements to provide benefit of those services for all <br />of the lots. <br /> <br />IO7 <br /> <br /> <br />
