16. <br /> <br />17, <br /> <br />18. <br /> <br />until: (a) vehicular access to the lot is provided including the installation of Class V <br />material on all streets in the Plat; (b) all utilities are in place, operational and accepted by <br />the CITY; and (c) boulevard sod and landscape tree, or escrow for same, have been <br />provided. <br /> <br /> SECTION IV <br />PARK DEDICATION <br /> <br />Cash Contribution. The Plat is located in the Oak Park District. Park dedication <br />requirements shall be satisfied by a cash payment in the amount of Twenty Nine <br />Thousand Seven Hundred Fifty Dollars and no cents ($29,750.00) (34 lots x $875.00 per <br />lot). This payment shall be made to the City prior to the release of the Final Plat for <br />recording. <br /> <br /> SECTION V <br />TRANSPORTATION AND LANDSCAPING <br /> <br />Park Trail Development Fee. The City Council has enacted a trail development fee in <br />the amount of One Hundred Dollars and no cents ($100.00) per lot. Therefore, a payment <br />in the amount of Three Thousand Four Hundred Dollars and no cents ($3,400.00) (34 lots <br />x $100/lot) is due at the City prior to releasing the Final Plat for recording. <br /> <br />Tree and Sod Planting Plan. If the Stage II boulevard seeding has not established, <br />sodded boulevards, in addition to a front yard tree, are a requirement for each lot in the <br />Plat prior to issuance of a Certificate of Occupancy. The DEVELOPER is required to <br />submit a Landscape Plan for CITY approval that identifies existing tree growth within <br />the Plat that will be preserved during construction and new plantings. The requirement <br />for a Landscape Plan shall be fulfilled by the DEVELOPER as follows: <br /> <br />Minimizing the impact of construction on trees in accordance with Minnesota <br />Extension Service publication "Protecting Trees From Construction Damage" <br />(Publication ~,IR-FO-6135-S). <br /> <br />b) <br /> <br />Planting one two-inch diameter tree (or equivalent thereof) of an approved species at <br />the road frontage or in the front yard of each of the lot in the Plat prior to the <br />issuance of a Certificate of Occupancy. In the event the weather is not conducive to <br />tree or planting sod in the boulevard at the time of Certificate of Occupancy, the <br />Building Permit holder shall place a cash deposit in the amount of $200.00 for trees <br />and $100.00 for sod in an escrow account with the CITY and upon verification of <br />the planting being accomplished, said cash deposit shall be refunded to the Building <br />Permit holder. Failure of the Builder to comply with the planting requirement within <br />a reasonable time frame following a determination by the CITY that weather <br />conditions are conducive to planting shall give the CITY authority to cause the <br />planting, the cost of which shall be charged to the escrow account and the Builder <br />shall not be eligible for a refund of the cash deposit made for this purpose. <br /> <br /> <br />
