DEVELOPMENT AGREEMENT <br /> <br /> This Agreement is by and between the CITY OF RAMSEY, Anoka <br /> County, Minnesota, a municipal corporation (the "CITY") and OAKWOOD <br /> LAND DEVELOPMENT, INC., a Minnesota corporation ("OAKWOOD"). <br /> <br /> R E C I T A L S <br /> <br /> WHEREAS, OAKWOOD is the fee owner of all the lots and blocks <br />in the plat known as Apple Ridge (the "Plat"); and <br /> <br /> WHEREAS, the CITY has granted final plat approval to the Plat <br />conditioned upon OAKWOOD entering into certain Development Agree- <br />ment, including this Development Agreement; and <br /> <br /> WHEREAS, the final Plat'approval of the Plat is conditioned <br />upon the construction, at developer's expense, of sanitary sewer <br />trunk and watermain trunk (the "Utilities") to serve the Plat. <br /> <br /> NOW, THEREFORE, it is agreed by and between the parties hereto <br /> <br />as follows: <br /> <br />1. CONSTRUCTION OF UTILITIES. <br />at its expense, the Utilities to <br /> <br />That OAKWOOD will construct, <br />serve the Plat. That the <br /> <br />Utilities shall be constructed in accordance with OAKWOOD's plans <br /> <br />submitted to the CITY and prepared by , <br /> <br />consisting of sheets and dated . The final <br /> <br />construction plans shall be submitted to the city Engineer for <br />review and approval prior to construction. OAKWOOD shall be <br />responsible for restoration of all disturbed areas within public <br />and private easements upon completion of construction. <br /> <br /> 2. ACQUISITION OF EASEMENTS.
