I <br />I <br />I <br />I <br />I <br />I <br /> <br />CASE #: <br /> <br />REQUEST FOR A CONDITIONAL USE PERMIT TO OPERATE A TWO-FAMILY <br />RENTAL UNIT IN THE SINGLE FAMILY DISTRICT; <br /> CASE OF SCOTT AND GWYN SIMPSON <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />On February 24, 1998, the City Council was presented with Scott and Gwyn Simpson's request <br />for a conditional use permit to operate a two family rental unit in the single family district at <br />16001 Nowthen Blvd. N.W. At that time, City Council directed City Staffto refine the proposed <br />f'mdings of fact and conditional use permit terms based on the discussion that evening. <br /> <br />Observations: <br /> <br />Item #7 of the Findings was modified to also reflect that a more timely reaction information on <br />file at the City could have prevented the proliferation of the illegal use on the property. <br /> <br />Council also needs to make a determination on the 'variable' £mdings 14 through 19 based on <br />their evaluation of the facts. <br /> <br />It is expected that duplexes or 2-family units would be developed in the Metropolitan Urban <br />Service Area of the City where paved driveways are a requirement. Therefore, Item #6 of the <br />conditional use permit was modified to require that the driveway and off-street parking area be <br />paved by October 31, 1998. This term also limits the number of cars parked outside to 4 at any <br />given time. <br /> <br />Item #7 of the proposed conditional use permit was modified to confnm that any outside storage <br />of personal and recreational equipment must be in accordance with current City Code <br />regulatigns. <br /> <br />The R-2 Urban Residential district regulations, for which duplexes or 2-family units are a <br />permitted use, requires each unit to have 240 square feet of garage space. Therefore, staff has <br />modified Item #8 of the proposed conditional use permit to require that each unit be provided <br />with 240 square feet of garage space by October 1, 2000. <br /> <br />Item # 9 of the proposed conditional use permit was modified to require (by April 10), that the <br />Simpson's provide proof that the existing septic system will handle a 6 bedroom unit and that <br />there are sufficient soils on site to support an alternate system in the event the existing septic <br />system failure. <br /> <br />The following items are enclosed for your information: <br /> <br />4 <br /> <br /> <br />
