Thc request was forwarded to the City's Comprehensive Plan consultant, Hoisington Koegler, for <br />review and comment. Mr. Scheib's response dated March 15, 1998 is enclosed for your review. <br />Basically, it states the subject site is impacted by several issues to be addressed in the <br />comprehensive plan update (blending non-compatible land uses, urban versus rural densities, <br />transportation, Mississippi River crossing) and that the moratorium should remain in place' for <br />this parcel. <br /> <br />With respect to the 5 criteria for granting exceptions, Council recommends the following <br />fmdings .- <br /> <br />1. Are there special circumstances or conditions such that strict application would deprive <br />the petitioner of reasonable use. <br /> <br />Finding: The subject property represents a prime example of why cities are given the authority <br />to impose moratoriums in the interest of good planning. The property has been dormant for <br />many years and an interruption of development rights is a temporary situation for a purpose that <br />may significantly benefit the petitioner. <br /> <br />2. That the exception is necessary for the preservation and enjoyment of a substantial <br />property right of the petitioner. <br /> <br />Finding: The exception is not necessary for the preservation of a substantial property right as the <br />moratorium is a temporary measure and all property rights will be restored in a reasonable time <br />frame. <br /> <br />3. That granting the exception will not be detrimental to the public welfare or injurious to <br />other property in the area. <br /> <br />Finding: The preferred use of this site is impacted by several issues to be addressed in the <br />comprehensive plan update: blending of non-compatible land uses, urban versus rural residential <br />densities, provisions for east/west collector streets, and the Mississippi River bridge crossing. <br />Development of this site prior to addressing'these issues may be detrimental to a plan that <br />provides' guidance and solutions for the public welfare.- <br /> <br />4. That the granting of the exception will be harmonious with and in accordance with the <br />objectives of the existing Comprehensive Plan and will not adversely affect the planning process <br />for adoption of amendments to the Comprehensive Plan. <br /> <br />Finding: The proposal is not in accordance with the current Comprehensive Plan and will have <br />an adverse affect on the comprehensive plan amendment in process. <br /> <br />5.
