<br />This Ordinance amends City Code:
<br />Section 30 -3 titled Property Condi
<br />tions constituting atpublic nuisance
<br />AND this Ordinance amends City
<br />Code Sectign 2 -332 titled' Abatement
<br />and relating to the abatement of
<br />grass, weeds or noxious growths in
<br />excess of eight inches in height.
<br />The. City of Ramsey ordains: c'

<br />SECTION 1. PURPOSE
<br />It the purpose of this Ordi-
<br />nance to(1) amend the City Code's
<br />• definition of that certain public nui-
<br />since to.tne height of grass,
<br />weeds or noxious growths of vegeta-
<br />tion, and (2) amend the City Code
<br />ptcess as it relates to the
<br />public nuisance of grass, weeds or
<br />noxio growths -of- vegetation which
<br />exceed eight inches in height
<br />- SECTION 2, AMENDMENT
<br />A.-city - Code Section-30 -300)
<br />declaring as a public nuisance grass,
<br />.:weeds or noxious growths of vegeta-
<br />tion Is amended to provide as follows:
<br />Alkgrass, weeds, or noxious
<br />growths of vegetation upon public or
<br />private property exceeding eight (8)
<br />inches in height, or whatever height
<br />specified-in the appropriate zoning
<br />district, excluding acceptable prairie
<br />restoration plant materials.
<br />8. City: Code. Section 2 -332
<br />Abatement, paragraph (d).Abate-
<br />ment Procedure (2) Procedure for
<br />,Public Nuisances a.3 s amended to
<br />provide as follows:
<br />3.
<br />i. The notice' shall also state that
<br />failure to abate the nuisance orviola-
<br />tion, or request a hearing within the
<br />applicabie;time will result. In
<br />abatement procedure , and that the
<br />cost of abatement with penalties and
<br />'interest will be billed`to-the property
<br />owner. Pursuant to applicable state
<br />statutes, any unpaid fees, and fines
<br />will be charged against the benefited
<br />■ property via special assessment under
<br />Minnesota Statutes for certification to
<br />'.the county auditor and collection
<br />:'along With current taxes the follow -
<br />-ing year or in annual installments not
<br />exceeding ten, as the council may
<br />detenninein each- case.' - -_ [ -:c
<br />ii: Notwithstanding the 14 day
<br />- notice described in paragraph a.
<br />above, and in: the case of a public
<br />nuisance defined In Section 30 -3
<br />relating to grass, weeds,' or noxious
<br />growths of vegetation upon public or
<br />private property exceeding eight (8)
<br />inches in height, the notice shall also
<br />state that in the event more than one
<br />abatement process for the same pub-
<br />. lic nuisance has beery on
<br />the same property within the previ-
<br />ous '12: month term, the nuisance or
<br />iwiolation-must be abated: withinfwe
<br />(5) business days; from,thedate:of
<br />'serviceofthe notice
<br />Notwithstanding paragraph
<br />a. 2. the noticeshall state that the
<br />-property owner maywithinfive (5)
<br />' : . business -days of the date of the
<br />'order, a.hearing before the
<br />hearing examiner and shall set out
<br />the procedure by which the hearing
<br />•.:may be requested.`:.:'.. ,
<br />The purpose of this provision is to
<br />insure -that the excessive growth of
<br />:grass,, weeds or noxious growths of
<br />vegetation is timely abated during
<br />the growing season. 'r
<br />SECTION 3. EFFECTIVE. DATE
<br />nr- This Ordinance becomes effec-
<br />tive upon its passage and thirty (30)
<br />days after its publication according to
<br />law, subject to City Charter-Section
<br />37.
