Councilmember <br />moved for its <br /> <br />adoption: <br /> <br />introduced the <br /> <br />RESOLUTION #98-04-__ <br /> <br />following resolution and <br /> <br />RESOLUTION AUTHORIZING ACQUISITION OF PROPERTY FOR HIGHWAY <br />PURPOSES. <br /> <br /> WHEREAS, the extension of C.R.#ll6 between C.R.#56 and C.R. <br />#83 will greatly enhance the arterial transportation network within <br />the City of Ramsey, and consequently will benefit the health, <br />safety and welfare of the City; and <br /> <br /> WHEREAS, Anoka County requires the city to obtain the right of <br />way for this road extension; and <br /> <br /> WHEREAS, the City finds it necessary to acquire fee title to <br />the real property described below for the required right of way, a <br />permanent utility easement for the necessary drainage facilities <br />associated with the new roadway and a temporary construct easements <br />to facilitate the construction; and <br /> <br /> WHEREAS, the City has authority to acquire the real property <br />for the Public Improvement by eminent domain pursuant to Minn. <br />Stat. Chapter 117; and <br /> <br /> WHEREAS, the city has the right to acquire the real property <br />prior to the filing of an award by the Court appointed commis- <br />sioners, pursuant to Minn. Stats. §117.011 and §117.042; and <br /> <br /> WHEREAS, the real property which needs to be acquired is <br />legally described as follows: <br /> <br />A 120.00 foot permanent easement for road, drainage and utility purposes over, under <br />and across the Northwest Quarter of Section 28, Township 32, Range 25, Anoka County, <br />Minnesota, the centerline of which Is described as follows: <br /> <br />Beginning at the intersection of the east ]ine of the Southeast Quarter of said <br />Northwest Quarter and altne 60.00 feet south of and parallel with the north line of <br />the Southeast quarter of said Northwest Quarter; thence North 89 degrees 2g minutes <br />O1 seconds West, assumed bearing along said parallel line, a distance of 220.76 feet; <br />thence northwesterly a distance of 821.52 feet along a tangential curve concave to <br />the northeast, said curve having a radius of logg.07 feet and a central angle of 42 <br />degrees 49 mlnutes 37 seconds; thence North 46 degrees 3g minutes 23 seconds West, <br />tangent to the last described curve, a distance of 800.00 feet to a point hereinafter <br />referred to as "Point A"; thence westerly a distance 821.51 feet along a tangential <br />curve concave to the south, said curve having a radius of logg.g? feet and a central <br />angle of 4Z degrees 4g minutes 35 seconds; thence North 89 degrees 28 minutes 58 <br />seconds West, tangent to the last described curve, a distance of 500.00 feet to the <br />westerly ]1ne of said Northwest Quarter and said centerline there terminating. <br /> <br />Said permanent easement containing 8.26 acres. <br /> <br />AND <br /> <br />A permanent easement for drainage purposes over, under and across that part of said <br />Northwest Quarter described as follows: <br /> <br /> <br />
