! <br />! <br /> <br /> case # <br /> <br />]iNITIATE CONDEMNATION FOR ACQUISITION OF <br />OUTLOT B, GATEWAY NORTH INDUSTRIAL PARK <br /> <br />By: <br /> <br />William K. Goodrich, City ~ttorney <br /> <br />Background: <br /> <br />In 1995, as a part of Improvement Project 94-20, the City installed <br />a sanitary sewer line in Outlot B, GATEWAY NORTH INDUSTRIAL PARK. <br />At the time of this installation the City had not acquired a <br />permanent easement from the landowner. The City had, however, <br /> <br />discussions with the landowner concerning the project and the <br />landowner attended the pre-construction meeting concerning the <br />project. To date, even though we have had several discussions <br />concerning purchase of the property, the City and landowner have <br />failed to reach an agreeable purchase price. The attached drawing <br />shows the location of the subject property. The city intends to <br />extend McKinley Street by use of this parcel some time in the <br />future, and the City intends to use this parcel for water utility <br />extension this year. As a result of the city's maintenance <br />building purchase some time ago, the City did acquire a roadway <br />easement across this parcel. <br /> <br />Recommendation= <br /> <br />city 'Staff recommends acquiring fee title to Outlot B, <br />NORTH INDUSTRIAL PARK, by commencing an eminent domain <br />provided for in the attached resolution. <br /> <br />GATEWAY <br /> action <br /> <br />Council Action: <br /> <br />Motion to adopt Resolution 98-04- which is a resolution to <br />commence an eminent domain action for the acquisition of Outlot B, <br />GATEWAY NORTH INDUSTRIAL PARK. <br /> <br />city Administrator <br /> <br /> <br />
