Councilmember moved for its adoption: introduced the following resolution and RESOLUTION #98-04- RESOLUTION AUTHORIZING ACQUISITION OF'PROPERTY FOR STREET, DP.~INA~E AND UTILITY PURPOSES. WHEREAS, the city as a part of Improvement Project 94-20 has installed sanitary sewer lines over, under and across Outlot B, GATEWAY NORTH INDUSTRIAL PARK ("Outlot B"); and WHEREAS, the city some time in the future intends to extend McKinley Street west to its intersection with Jasper Street over and across Outlot B; and WHEREAS, the City intends to extend its watermains to service the AEC Energy Park over, under and across Outlot B; and WHEREAS, the City has authority to acquire real property for Public Improvements by eminent domain pursuant to Minn. Stat. Chapter 117; and WHEREAS, the City has the right to acquire the real property prior to the filing of an award by the Court appointed commis- sioners, pursuant to Minn. Stats. §117.011 and §117.042; and WHEREAS, the real property which needs to be acquired for the sanitary sewer, water and street purposes described above is legally described as follows: Outlot B, GATEWAY NORTH INDUSTRIAL PARK, Anoka County, Minnesota; which parcel is Anoka County PIN: 27-32-25-34-0005; and WHEREAS, the property owner of the real property which needs to be acquired has been identified by the City as follows: Bury & Carlson, Inc., a Minnesota corporation NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOEA COUNTY, STATE OF MINNESOTA, as follows: That the City Administrator is hereby directed to acquire the real property as described above in accordance with Minnesota Statutes.
