! <br />! <br /> <br />~ase # /P <br /> <br />CONSIDER POLICY FOR INDIVIDUAL REQUESTS <br />TO GRANT AN EXCEPTION TO THE <br /> MORATORIUM ORDINANCE <br /> <br />By: William K. Goodrich, City Attorney <br /> <br />Background: <br /> <br />On July 7, 1997 the City adopted an ordinance placing a moratorium <br />on the subdividing and rezoning of all residential zoned property <br />within the City and all industrial/commercial property lying <br />outside the MUSA Boundary. Currently the moratorium is scheduled <br />to expire in July, 1998 and there is some possibility staff will be <br />recommending extending the term of the ordinance. <br /> <br />Several individuals have recently approached the City to have the <br />moratorium lifted as to their specific parcel. The Moratorium <br />Ordinance does permit an exception if the Council finds "undue <br />hardship". The Council has requested the City adopt a policy to <br />address these individual requests. <br /> <br />Recommendation: <br /> <br />Staff proposes the following policy: <br /> <br />Each request for exception to be reviewed by the City's <br />Consulting Comprehensive Planner (Hoisington Koegler <br />Group, Inc.) for their recommendation. <br /> <br />Each request for exception shall be accompanied by a <br />$250.00 escrow deposit to be used for payment of the <br />Planner's charge to the City for their review and written <br />report. Unused funds to be returned to applicant. <br /> <br />The Planner's report shall be reviewed by city Staff with <br />the applicant. <br /> <br />The applicant shall make the decision as whether he/she <br />desires to be placed on a City Council agenda for formal <br />consideration of the moratorium exception request. <br /> <br />council Action: <br /> <br />Motion to adopt the foregoing Moratorium exception policy. <br /> <br />Review Checklist: <br /> City Administrator <br /> Zoning Officer <br /> <br /> <br />
