Mr. Hendriksen stated that he has, several times, <br />given his interpretation of Chapter 14 of the Charter dealing with the MUSA expansion. He did <br />not see a reference to the Charter on the expansion of the MUSA but the plan seemed to show an <br />expansion. <br /> <br /> $ <br /> <br />Mayor Garnet pointed out that the City is looking at an idea. We do not know if we will have to <br />initiate a MUSA expansion or not. If it appears an expansion is needed, Council will initiate the <br />process - the referendum vote, etc. <br /> <br />Mr. Hendriksen inquired what the City's official stand is on this matter. <br /> <br />City Attorney Goodrich replied that the City has not adopted an official position other than we <br />will comply with the law. <br /> <br />Mr. Hendriksen stated that both concepts of the Comprehensive Plan showed an expansion of the <br />MUSA. He asked when Council would expect to hold the vote on Charter Chapter 14.1.1 and <br />14.1.3. <br /> <br />Mr. Goodrich indicated that he is not prepared to comment on that this evening. He reiterated <br />that the City has taken no formal position, only that we will comply with the law. <br /> <br />Mr. Hendriksen felt that it is cause for concern that the City Council or Attorney may have a <br />different interpretation of the Charter - and that it appears the Attorney is not willing to share his <br />opinion with the public and it also appears that the City is not upholding the Charter. He <br />requested that the City outline the steps they anticipate following so the citizens will know what <br />the City's position is. <br /> <br />Mayor Gamec specified that until a vote or action is taken by Council, no proceedings have to <br />take place. <br /> <br /> Mr. Hendriksen stated that it seems the City Council is not in charge of this process and he <br /> suggested that is a poor way to run the City -- without knowledge. He again stated that both <br /> plans presented showed a MUSA expansion. <br /> <br /> Mayor Gamec reiterated that nothing takes place until Council votes on something. If we vote <br /> on a plan with a MUSA expansion, we will then have to vote on a referendum. It may also be a <br /> possibiliW that Council would vote down both plans. Until Council votes on an issue, no action <br /> is taking place. <br /> <br /> Attorney Goodrich pointed out that he gave his formal opinion on this issue at a Council meeting <br /> a couple of months ago. ,, <br /> Mr. Hendriksen argued that the Charter talks about "at the initiation -- with planning and <br /> approval - he felt that Council has gone beyond the initiation.
