The following items are enclosed for your information:

a)
b)
c)
d)
e)

Site location map
Site Plan
Draft Planning Commission meeting minutes dated May 5, 1998
Proposed findings of fact
Proposed conditional use permit

Notification:

State Statute requires notification of the public hearing to all properties within 350 feet of the
subject property. Staff attempted to notify property owners within 700 feet of the subject
property.

Observations:

The subject property is 2.3 acres in size and is restricted to a total of 2,064 square feet of garage
and accessory building space. In addition, there is a 1,200 square foot size restriction on any
single accessory structure. The Aberle's currently have a 936 square foot garage. They are
proposing to construct a 1,500 square foot accessory building in Which to store personal vehicles
and equipment along with certain commercial vehicles and equipment. Mr. Aberle is a self-
employed remodeling contractor and in accordance with Section 9.11.10 of the Rarnsey City
Code, is attempting to store his commercial equipment and vehicles indoors. The conditional use
permit has been drafted to emphasize that Mr. Aberle may park and store his commercial
equipment at his home, but that does not give him the right to operate a commercial business
from his garage.

The addition of the proposed 1,500 square foot accessory building will increase the total garage
space on the property to 2,436 square feet, which is a 372 square foot overage. It also rel~resents
a 300 square foot overage in the size restriction for any single accessory structure.

The City has approved overages in accessory buildings in the past.
