CASE # <br /> <br />CONSIDERATION OF NO WAKE ORDINANCE ON RUM RIVER <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />Various residents along the Rum River in Andover ha.v.e requested that the Andover City Council <br />establish no wake zones to curb the erosion that is occurring. Establishment of no wake zones on <br />the river requires the cooperation of all communities on either side of the river for the area to be <br />so posted. In 1997, various Andover and Ramsey staff took a boat trip down the river and <br />identified four sensitive areas along the Rum River that merit consideration for no wake zones <br />(see enclosed exhibit). To that end, Andover has requested that the City of Ramsey enter into a <br />joint powers agreement to establish some no wake zones on the Rum River. <br /> <br />Per Council's direction, City Staff drafted and advertised a proposed ordinance (see enclosed <br />exhibiO that would establish the entirety of the Rum River in the city limits as a no wake zone in <br />order to give all persons along the river the opportunity to comment on the matter. If Council <br />chooses, to establish less than the entire river as a no wake zone, they can make that reduction at <br />the first reading or introduction of the ordinance. <br /> <br />Andover City Staff estimates the cost to post no wake zones will be $1,000.00, which would be a <br />shared cost with the City of Ramsey. The Anoka County Sheriff's Department would provide <br />for the enforcement of the no wake regulations at no additional cost to the City. <br /> <br />As an aside, State law currently states that jet skis cannot exceed a 'slow - no wake' speed in <br />areas of the river that are less than 200 feet irt width. (Most of the Rum River is less than 200 <br />feet in width). State law also states that a 'slow - no wake' speed is in place for areas of the river <br />within 100 feet of a dock or swim rafL These laws could be posted at the public launches but <br />that may not be as effective as establishing and posting no wake zones. <br /> <br />Recommendation: <br /> <br />Receive public comments and direct modifications to the proposed ordinance as deemed <br />necessary. Introduce the ordinance for establishment of no wake zones on the Rum River. <br /> <br />Council Action: <br /> <br />Motion to introduce an ordinance to establish no wake zones on the Rum River as proposed or as <br />0~mended; or... <br /> <br />Motion to decline the City of Andover's request for a joint powers agreement for no wake zones <br />on the Rum River. <br /> <br />Review Checklist: <br /> <br />City Administrator <br />City Attorney <br /> <br />CC: 06/09/98 <br /> <br /> <br />
