CASE #: ,_~ <br /> <br />REQUEST FOR FINAL PLAT APPROVAL OF GOBERNATZ 2ND ADDITION; <br />CASE OF JOHN GOBERNATZ <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />John Gobematz is requesting final plat approval to create two new 2.5 acre lots from his 35 acre <br />homestead located on the south side of 177th Avenue N.W., east of St. Francis Blvd. N.W. The <br />following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br /> <br />d) <br />e) <br />f) <br /> <br />Site location map <br />Proposed final plat <br />Draft Planning Commission meeting minutes dated June 2, 1998 (will be <br />available at the meeting) <br />Final plat review letter dated June 3, 1998 <br />Proposed development agreement <br />Proposed resolution for final plat approval <br /> <br />Notification: <br /> <br />The plat is a minor subdivision for which no public hearing is required. <br /> <br />Observations: <br /> <br />On March 24, 1998, the City Council exempted Mr. Gobematz's property from the subdivision <br />and rezoning moratorium. The 3 lot minor subdivision on 35 acres is in conformance with 4 <br />units in 40 acres density restrictions. The development agreement has been drafted to prohibit <br />any future subdivision of the property until the 4 in 40 restriction is repealed or reduced, or city <br />sewer and water are available to the property. <br /> <br />In 1989, Mr. Gobernatz gave two of his four children a 2.5 acre lot from the then 40 acre <br />homestead. In 1990, the minimum lot size north of Trott Brook was increased from 2.5 acres to <br />10 acres. Now Mr. Gobernatz is proposing to replat his homestead into a 30 acre parcel for <br />himself and two 2.5 acre lots for the remaining two children. His case was presented to the <br />Board of Adjustment and they granted him a variance to the 10 acre minimum lot size <br />requirement in order that all four children will receive equally sized parcels. All three of the lots <br />in this plat meet the 200 feet of frontage on a public road requirement. <br /> <br />City Staff and the Anoka County surveyor's office are recommending that the wetland on the <br />south end of the plat be dedicated as a drainage and utility easement, and with the exception of <br />the existing driveway onto T.H. #47, all right of access adjacent to T.H. #47 should be dedicated <br />to the State. <br /> <br /> <br />
