'I. <br />IMPROVEMENTS <br /> <br />Access to Lots. Lots 1 and 2 shall have public access from 177th Avenue N.W., an <br />existing improved public street, and Lot 3 shall retain an existing access onto T.H. #47 <br />(St. Francis Blvd. N.W.). ',. <br /> <br />Access From Trunk Highway #47. With the exception of the existing access from Lot <br />t onto T.H. #47, the DEVELOPER herein agrees to transfer right-of-access adjacent to <br />T.H. #47 to the State. <br /> <br />Drainage and Utility Easements. The standard drainage and utility easements around <br />the perimeter of each of the three lots, together with the wetland on the southern portion <br />of Lot 3 shall be dedicated as drainage and utility easements on the final plat. <br /> <br />Resubdivision Restrictions. Under 4 in 40 density regulations, it is herein agreed that <br />the Plat, based on the underlying legal description, is limited to a total of three (3) lots <br />and no further resubdivision of any lot in the Plat will be permitted until sanitary sewer <br />and municipal water are available to th.e Subject Property or the repeal or reduction of the <br />4 in 40 density restrictions. <br /> <br />II. <br />GENERAL <br /> <br />Park Dedication. The Plat is in the Rum River Park District. The DEVELOPER shall <br />satisfy the park dedication requirement with a . This <br />obligation must be fulfilled prior to the City releasing the Final Plat for recording. Any <br />future resubdivision of the plat will require additional park dedication. <br /> <br />Park Trail Development Fee. The City Council has enacted a trail development fee in <br />the amount of One Hundred Dollars and no cents ($t00.00) per lot. Lot 1, the existing <br />homestead, is exempt from this fee. Therefore, a payment in the amount of Two Hundred <br />Dollars and no cents ($200.00) is due at the City prior to releasing the Final Plat for <br />recording. <br /> <br />Stormwater Management Fee. The CITY has enacted a Stormwater Management Fee <br />in the amount of Three Hundred Fifty Eight Dollars and no cents ($358.00) per unit. Lot <br />3, the existing homestead, is considered by the City to be exempt from this fee. The <br />amount of Transportation Impact Fee due on the Plat is Seven Hundred Sixteen Dollars <br />and no cents ($716.00). This obligation must be fulfilled prior to the City releasing the <br />Final Plat for recording. <br /> <br />Tree Disease Prevention and Disposal. The DEVELOPER' shall prevent the <br />introduction and spread of tree disease into the residual tree populations of the Plat and <br /> <br /> <br />
