I I CASE REQUEST FOR AN EXTENSION OF COlqI)ITIONAL USE PERMIT TO CONSTRUCT ACCESSORY STRUCTURES PRIOR TO THE PRINCIPAL STRUCTURE; CASE OF DAVID HANSEN, HANSEN TREE FARM By: Zoning Administrator Sylvia Frolik Background: City Code prohibits the construction of accessory buildings on a parcel without the existence of a principal building on the property. On May 27, 1997, City Council granted a conditional use permit to David Hansen of the Hansen Tree Farm to construct two accessory structures at their facility prior to there being a home or principal building on the property. Unless an extension is granted by the City Council, the City Code states that conditional use permits are considered void unless the use is completed within 12 months of approval of the permit. Observations: The conditional use permit granted gave the Hansen's until May 27, 1998 to construct the fn'st accessory building and until October of 2002 to construct the second building. The City has received a written request from David Hansen for a 6 month extension to the permit for the construction of the first accessory building. The 1997 construction season was drastically interrupted for tree repair and clean-up efforts resulting from the windstorm of July, 1997. Notification: Notification to area property owners of a request for extension of conditional use permit is not required. Recommendation: The Planning Commission unanimously recommended that Council approve the six month extension.
