CASE <br /> <br /> REQUEST FOR MINOR COMPREHENSIVE PLAN AMENDMENT <br />TO MODIFY THE METROPOLITAN URBAN SERVICE AREA BOUNDARY; <br />CASE OF DOLPHIN REAL ESTATE PARTNERSHIP <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />As you may recall, Council approved the site plan for a Burger King facility in the <br />northwest quadrant of Hwy. #10 and Ramsey Blvd. on August 12, 1997. The site is just <br />outside the Metropolitan Urban Service Area boundary and was proposed to be served <br />with an on-site septic system and well. Subsequent to the site plan approval, the <br />developer (Greg Dolphin of Dolphin Real Estate Partnership) has determined through <br />experiences in another community that on-site septic systems for fast food restaurants are <br />problematic and costly. Consequently, on June 9 the Ramsey City Council received Mr. <br />Dolphin's request for a MUSA boundary modification to include their 3 acre site in order <br />that the facility may be serviced with municipal water and sanitary sewer <br /> <br />Observations: <br /> <br />The request constitutes a minor comprehensive plan amendment. Accordingly, on June 9 <br />the City Council directed City Staff and the Planning Commission to process the request <br />through proper procedures. A public hearing in front of the Planning Commission was <br />scheduled for Monday, June 22. The results of that heating and the Commission's <br />recommendation to City Council will be presented in a verbal report by City Staff at the <br />Council meeting on June 23. <br /> <br />Recommendation: <br /> <br />Will be based on the results of the June 22 Planning Commission meeting. <br /> <br />Council Action: <br /> <br />Motion to accept the recommendation of the Planning Commission and approve/deny the <br />proposed minor comprehensive plan amendment to modify the MUSA boundary So <br />include the proposed Burger King site, and to direct City Staff to forward the amendment <br />to Metro Council for approval. <br /> <br />Review Checklist: <br />City Administrator <br />City Attorney <br /> <br />CC: 06/23/98 <br /> <br /> <br />
