Given Staff's policy of only advising of future subdivision possibilities, Mr. Hamann could build <br />the accessory building anywhere he wanted to on the lot if he wasn't proposing to exceed the size <br />restrictions. His need for a conditional use permit to exceed size requirements gives the City the <br />opportunity to consider the proposed location' of the building in relationship to the established <br />aesthetic standards of the neighborhood. <br /> <br />The following items are enclosed for your information:, <br /> <br />a) <br />b) <br />c) <br />d) <br />e) <br /> <br />Site location map <br />Site Plan <br />Draft Planning Commission meeting minutes dated 6/2/98 <br />Proposed findings of fact <br />Proposed conditional use permit <br /> <br />Recommendation: <br /> <br />Despite the Zoning Administrator's advice, the Planning Commission formulated a positive <br />findings of fact on which to base their recommendation for denial. Their recommendation was a <br />result of the proposed location of the accessory building not being in conformance aesthetically <br />with established standards in the neighborhood. However, one of the Planning Commissioners <br />did qualify his denial recommendation to be based on the fact that he believes size restrictions <br />should be adhered to. <br /> <br />City Staff recommends that if Council is inclined to deny the request, that the findings of fact be <br />amended to conform with the action about to be taken, otherwise the action will be considered <br />arbitrary.
