Given Staff's policy of only advising of future subdivision possibilities, Mr. Hamann could build the accessory building anywhere he wanted to on the lot if he wasn't proposing to exceed the size restrictions. His need for a conditional use permit to exceed size requirements gives the City the opportunity to consider the proposed location' of the building in relationship to the established aesthetic standards of the neighborhood. The following items are enclosed for your information:, a) b) c) d) e) Site location map Site Plan Draft Planning Commission meeting minutes dated 6/2/98 Proposed findings of fact Proposed conditional use permit Recommendation: Despite the Zoning Administrator's advice, the Planning Commission formulated a positive findings of fact on which to base their recommendation for denial. Their recommendation was a result of the proposed location of the accessory building not being in conformance aesthetically with established standards in the neighborhood. However, one of the Planning Commissioners did qualify his denial recommendation to be based on the fact that he believes size restrictions should be adhered to. City Staff recommends that if Council is inclined to deny the request, that the findings of fact be amended to conform with the action about to be taken, otherwise the action will be considered arbitrary.
