CASE # <br /> <br />REQUEST FOR FINAL PLAT APPROVAL OF REGISTERED LAND SURVEY <br />FOR SUNWOOD DRIVE RIGHT-OF-WAY <br /> By: City Attorney William Goodrich <br /> <br />Background: <br /> <br />When the City finally settled its land issues, etc., with Waste Management of Minnesota, <br />Inc. (WMMI), we acquired right-of-way for the future extension of Sunwood Drive <br />across various parcels owned by WMMI between County Road #116 and Sunfish Lake <br />Blvd. <br /> <br />Observations: <br /> <br />One of the tracts through which the right-of-way traverses is registered land or torrens <br />property. Because of this, the Anoka County Registrar of Titles office will not accept the <br />recording of a deed from WMMI to the City for the right-of-way without the preparation <br />of a Registered Land Survey (RLS). <br /> <br />Therefore, the City has directed Hakanson Anderson Associates to prepare the RLS and <br />staff is presenting it to City Council for approval pursuant to the minor plat procedure of <br />Section 9.50.05, Subd. 2, of the City Code. <br /> <br />Recommendation: <br /> <br />City Staff recommends approval of the RLS. <br /> <br />Council Action: <br /> ,- <br />Motion to adopt Resolution #98-06-.~_~approving the RLS for Sunwood Drive in the <br />Northwest quarter of the Southeast quarter of Section 27. ./~ <br /> <br />CC: 06/23/98 <br /> <br />/I <br /> <br /> <br />
