He stated when he was serving on the <br />Charter Commission they address how a residential area could petition for sewer and water, but <br />this may be easier to deal with through an ordinance. <br /> <br />Couneilmember Haas Sterffen stated that she would like to direct staff to negotiate with <br />Hoisington Koegler to have them address ordinances and give some assurances to residents that <br />this move is not to sewer the entire City. <br /> <br />City Attorney Goodrich stated he could give an inventory of what is in the charter and ordinances <br />to protect the residents from forcing sewer and water into existing residential neighborhoods. <br /> <br />Motion by CoUncilmember Haas Steffen and seconded by Councilmember Beyer to refer the legal <br />opinion as to the validity of Charter Section 14.1 dealing with modification of the MUSA to the <br />Charter Commission for its review and comment. <br /> <br />Motion Carried. Voting Yes: Mayor Gamee, Councilmembers Haas StelF. en, Beyer, Beahe~ and <br />Coun¢ilmember Zimmerman. Voting No: None. <br /> <br />City Attorney Goodrich announced that the Charter Commission has scheduled a meeting to <br />address this specific issue on 3uae 15, 1998, 6:30 p.m., at the City 14011. <br /> <br />Motion by Councilmember Haas Steffen and seconded by Councitmember Beahen to direct staff <br />to negotiate with Hoisington Koegler to address ordinances as indicated and to dkect City <br />Attorney Goodrich to inventory what is in the charter and ordinances to protect residents from <br />being forced to connect to sewer and water. <br /> <br />Mayor Gamee concurred that the key issue is to remove the fear of residents about being forced <br />to connect to sewer, <br /> <br />Motion Carded. Voting Yes: Mayor Garnec, Councilmembers Haas Steffen, Beaher[ Beyer, and <br />Zimmerman. VotingNo: None. <br /> <br />Councilmember Haas Steffen noted there is to be more review of Charter amendments. <br /> <br />City Attorney Goodrich stated this is correct and they have investigated the third Charter <br />amendment dealing with density.
