Councilmember introduced the following resolution and moved for its <br />adoption: <br /> <br />RESOLUTION #98-07- <br /> <br />RESOLUTION DECLARING THE CONSTR'UCTION IMPACTS TO THE T.H. <br />#47 PEDESTRIAN TRAIL TO BE MINOR AND TEMPORARY <br /> <br /> WHEREAS, the T.H. #47 STP Project will require a temporary easement to <br />regard the western 10 to 20 feet of a 40-foot park trail easement lying along the eastern <br />boundary of the T.H. g47 right-of-way; and <br /> <br /> WHEREAS, this grading work will not impact the existing trail constructed on <br />the eastern portion of this park trail; and <br /> <br /> WHEREAS, pursuant to the Federal Registration Rules and Regulations 23CFR <br />771.135(7), this temporary easement is considered a temporary occupancy of 4CF) lands; <br />and <br /> <br /> WHEREAS, to proceed with the design and construction of T.H. #47, there must <br />be a documented agreement that the officials having jurisdiction over the resource concur <br />with the work to be done. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1) <br /> <br />That the duration of the work associated with the reconstruction of T.H. 47 will be <br />both temporary and minor. <br /> <br />2) <br /> <br />That there are no anticipated permanent adverse physical impacts, nor will there <br />be interference with the activities of the park trail on either a permanent or <br />temporary basis. <br /> <br />3) <br /> <br />That the land being used will be fully restored to a condition which is at least as <br />good as the one that existed prior to the project. <br /> <br />4) <br /> <br />That the Ramsey City Council hereby finds that the proposed work constitutes a <br />temporary occupancy of the park land access and, as such, does not constitute use <br />within the meaning of Section 4(F). <br /> <br />The motion for <br />Councilmember <br />favor thereof: <br /> <br />the <br /> <br />adoption of the foregoing resolution was duly seconded by <br /> and upon vote being taken thereon, the following voted in <br /> <br />and the following voted against the same: <br /> <br /> <br />
