I I I I I I I I I I I I I I I I I CASE # REQUEST FOR A CONDITIONAL USE PERMIT FOR A PERSONAL COMMUNICATION SERVICE TOWER; CASE OF U.S. WEST WIRELESS By: Zoning Administratpr Sylvia Frolik Background: The City has received an application from U.S. West Wireless to construct and operate a personal communication service (PCS) tower at 9421 Hwy. #10, which is occupied by Instantop and owned by Carrol and Frances Welte. The following items are enclosed for your information: a) b) c) d) e) Site location map Proposed site plan and related support documents Draft Planning Commission public hearing and meeting minutes dated 7/7/98 Proposed findings of fact Proposed conditional use permit Notification: State law requires that properties within 350 feet of the subject property be notified of the public hearing. Staff attempted to notify properties within 700 feet of the public hearing pertaining to the request. Observations: The applicant is proposing to construct a 120 foot monopole tower in the southeast comer of this site. The unmanned ground equipment will be mounted on a 3' x 12' x 6' rack mounted on a cement base. The tower and equipment will be encompassed by an 8 foot high chain link fence. The ground equipment and fencing will be screened by existing oak trees on the west and the applicant is proposing to plant 7 black hills spruce trees on the south and east boundaries of the site. At the time of Planning Commission review, Staff recommended that the landscape plan be add a couple of trees and in-fill with shrubbery. The Applicant has submitted a revised plan which added 2 honeylocust trees and 4 dogwood shrubs. There will be no personnel stationed at the site. No signs will be posted on the tower or cabinets except applicable warning or equipment information signs. The existing site access is sufficient. The site is zoned Business. The site to the north is occupied by the Burlington Railroad, the adjacent properties to the east and west are also zoned Business, and the site is bounded by Hwy. # 10 on the south.
