I I I I I I I I I I I I I I I I I I I CASE # REQUEST TO PLACE BUSINESS IDENTIFICATION SIGN ON CITY PROPERTY; CASE OF DIAMONDS SPORTS BAR AND GRILL By: Zoning Administrator Sylvia Frolik Background: The developers of the Diamonds Sports Bar and Grill have applied for a sign permit for a free-standing ground sign that is in compliance with City Code. However, because of their obligation in platting The Diamonds, they have deeded their highway frontage to the City as Outlot A for the possible future extension of Riverdale Drive. The literal interpretation of the sign ordinance would require them to place their sign on the south side of Outlot A or more than 80 feet back from the highway right-of-way. Mr. Gruber is requesting the City's permission to place the sign on Outlot A, adjacent to the highway, until such time as Riverdale is constructed. The lease agreement will clearly spell out that at such time the City decides to construct Riverdale Drive, it will be the obligation of Diamonds Sports Bar and Grill to move the sign. Enclosed is an exhibit of the proposed sign location and sign. Recommendation: Because of the cooperation demonstrated by Mr. Gruber during the platting of the Diamonds to work with the City and the County to preserve a Mississippi River bridge corridor and a highway frontage road, City Staff recommends approval of the request to place the sign on Outlot A. If the City Council agrees, then the City Attorney should be directed to draft a lease agreement that establishes the sign location, lease amount, and removal time frame. Council Action: Motion to authorize the Mayor and City Administrator to enter into a lease agreement, approved by the City Attorney, with the Diamonds Sports Bar and Grill for the placement of their business identification sign on Outlot A of The Diamonds.
