In the event Lessor cannot accommodate Lessee's additional <br />equipment, then Lessee shall have the option in it's sole discretion to terminate this <br />agreement and have no further obligation thereunder. Any additional equipment <br />may result in additional rent to be charged to Lessee. <br /> <br />ELECTRICAL INTERFERENCE. Lessor and Lessee agree that due to the nature of <br />Lessor's business some electromagnetic interference may be generated within the <br />building housing Lessee's equipment. In the event this electromagnetic interference <br />causes Lessee's equipment to malfunction, Lessee shall immediately notify Lessor <br />in writing at which time Lessor shall make an effort to eliminate, reduce or filter out <br />the interference. Lessor shall not make any alteration or modification to Lessee's <br />equipment including transmission lines or antenna locations without the expressed <br />written consent of Lessee; however Lessee shall make available to Lessor technical <br />information on Lessee's equipment and on the type of interference being <br />experienced to assist Lessor in eliminating, reducing or filtering out the interference. <br />In the event Lessor is unable to eliminate the interference, or reduce it to a level <br />acceptable to Lessee, within a period of thirty (30) days then Lessee may terminate <br />this Agreement. <br /> <br />In the event that Lessee's equipment causes interference to existing lessees, Lessor <br />shall immediately notify Lessee in writing at which time Lessee shall make an effort <br />to eliminate, reduce or filter out the interference. <br /> <br />19. <br /> <br /> In addition Lessee shall have the right to terminate this agreement upon ninety <br />(90) days written notice should its reception or transmission be interfered with or <br />affected by other antenna and equipment, or by obstacles such as buildings, <br />additions, towers or other structures which might be constructed or maintained in <br />Lessee's receiving or transmitting paths after the date of this agreement. Neither <br />Lessor nor Lessee shall have any further obligation under this lease other than <br />Lessee's obligation to remove all of it's equipment from the premises. <br /> <br />NOTICES. Any notice or demand required or permitted to be given or made <br />hereunder shall be sufficiently given if made by certified mail in a sealed envelope, <br />postage prepaid, addressed to Lessor or Lessee, as applicable, to their respective <br />addresses as set forth on the page one of this Agreement. Any such notice or <br />demand shall be deemed to have been given or made at the time it is deposited in <br />the United States Post Office. Lessee or the Lessor may from time to time <br />designate any other address for this purpose by written notice to the other party. <br /> <br />20. WAIVER. Failure or delay on the part of Lessee or the Lessor to exercise any right, <br /> power or privilege hereunder shall not operate as a waiver thereof. <br /> <br />21. PRIOR NEGOTIATIONS. This lease constitutes the entire Agreement of the <br /> parties hereto and shall supersede all prior offers, negotiations and agreements. <br /> <br /> 9 <br />PageMart Wireless, Inc.
