3. Sectxon S. 6 of the city Charter. This Section does not permit <br /> the City to levy an assessment or require any property owner <br /> to connect to City sewer or water if the property has <br /> working or functional private sewer or water syste/~. <br /> Ordinance No. 97.04 implements'Charter Section 8.6. <br /> <br />4. ~ect~on 4.60 of the city Co~. This section ~mplem~nts' <br /> Charter Sections 8.1 through 8.5 with certain exceptions <br /> mandated by the City Charter. Section 4.60 of the City Code <br /> incorporates Chapter 429 of Minnesota Statutes, which is the <br /> State law by which statutory cltles must follow in the making <br /> and assessing of local improvements. This extensive body of <br /> law. contains many procedural protective measures for <br /> residents. <br /> <br />The Council also asked tha~ we discuss this ~ssue with the <br />Hoisington Koegler Group for lnput on additional s%mllar resident <br />assurances which might be adopted by ordinance.
