I <br />I <br />I <br />I <br /> <br /> I <br /> I <br /> I <br /> I <br />I <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />CASE # <br /> <br /> REQUEST FOR A CONDITIONAL USE PERMIT <br />TO GRADE AND EXPORT SOILS; CASE OF GERALD BAUER <br />By: City Engineer Steve Jankowski <br /> <br />Background: <br /> <br />On June 12, 1998, Mr. Gerald Bauer submitted an application to the City for a conditional use <br />permit to grade and export approximately 693,000 cubic yards of earth material from his <br />property located generally north of the Burlington Railroad and east of Puma Street. <br /> <br />The following items are enclosed: <br /> <br />1) Site location map <br />2) Original Grading Plan <br />3) Planning Commission public hearing and meeting minutes dated July 7, 1998 <br />4) Draft Planning Commission public hearing and meeting minutes dated August 4, <br /> 1998 <br />5) Proposed findings of fact <br /> <br />6) Proposed conditional use permit <br /> <br />Notification: <br /> <br />State statute requires notification of the public hearing to property owners within 350 feet of the <br />subject property. Staff attempted to notify property owners within 700 feet of the subject <br />property of the public heating. <br /> <br />Observations: <br /> <br />The applicant has indicated that the ultimate deposition of the subject property will be the <br />development of residential housing. It is likely that the area will ultimately be serviced with <br />sewer and water. <br /> <br />The proposal submitted proposes grading 65 acres of property to a finished elevation of between <br />875.8 and 875.1. An area north of parcels 4 and 5 also appears to be proposed for grading. The <br />limit of the grading will be the 875 contour. <br /> <br />The overall concept of removing material from the site using a haul route through the <br />Adolphson-Peterson property to County Road #83 is acceptable to staff and the Planning <br />Commission. There is concern, however, relating to the flatness of the final grade and what <br />impacts that may cause on storm drainage of the site after it is developed. There was agreement <br />between staff, the Planning Commission, and the applicant that the grading plan would need to <br />be revised such that the entire site would have a minimum of one-half percent grade to the 875 <br />contour. The revised plan should also incorporate a tree restoration plan along railroad tracks. <br /> <br /> <br />
