I <br />I <br />I <br />I <br />i <br />I <br />I <br />I <br />I <br /> <br />Councilmember <br />adoption: <br /> <br />introduced the following resolution and moved for its <br /> <br />RESOLUTION #98-08- <br /> <br />RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT <br />BASED ON FINDINGS OF FACT # AND DECLARING TERMS OF PERMIT TO <br />GRADE AND EXPORT SOILS <br /> <br /> WHEREAS, <br />Findings of Fact # <br />following conditions. <br /> <br /> the Ramsey City Council adopted Resoluti/~h No. 98-08- adopting <br />__ for this use and herein approves the Conditional Use Permit subject to the <br /> <br />NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br /> ':~:' i'~ ..'.'~; ~' <br />On July 28, 1998 a Conditional Use Permit ("CUP") was issued by the City of Ramsey ("City") to <br />Gerald Bauer ("Permit Holder") for grading operations on the property legally described as follows: <br /> <br /> The Northeast Quarter of the Northwest Quarter and the Northwest Quarter of the Northeast <br /> Quarter of Section 29, Township 32, Range 25, Anoka County, Minnesota, lying north of <br /> the Burlington Northern Railroad easement. <br /> <br />-and- <br /> <br />The south 370 feet of Outlot A, Block 1, Pine Shadows, Anoka County, Minnesota. <br /> <br />("Subject Property:") <br /> <br />This permit is issued pursuant to Section 9.03.04 and 9.1.18 of the Ramsey City Code. The <br />conditions of this permit are as follows: <br /> <br />1. This permit shall expire three (3) years fi.om the date of commencement of operations and the <br /> Permit Holder shall be responsible for providing the City with at least 48 hours advance <br /> notice of the date of commencement of operations. <br /> <br />The ingress and egress to the Subject Property shall be from Armstrong Blvd. NW and a <br />private easement across Lot 2, Block 1, IFf-10 Ramsey 2nd Addition. The Permit Holder <br />shall utilize an existing gravel approach at the access point onto Armstrong Blvd. NW to <br />minimize the tracking of grading materials from the site onto the public highway. The Permit <br />Holder shall be responsible for obtaining and complying with any permits deemed necessary <br />from Anoka County. In addition, the Permit Holder shall be responsible for removing any <br />spilled material from the public roads immediately upon direction to do so by the City <br />Engineer. Failure to do so shall be cause for the City Engineer to order the necessary work to <br />be done and billed to the Permit Holder. <br /> <br /> <br />
