I I I I i I I I I Councilmember adoption: introduced the following resolution and moved for its RESOLUTION #98-08- RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT BASED ON FINDINGS OF FACT # AND DECLARING TERMS OF PERMIT TO GRADE AND EXPORT SOILS WHEREAS, Findings of Fact # following conditions. the Ramsey City Council adopted Resoluti/~h No. 98-08- adopting __ for this use and herein approves the Conditional Use Permit subject to the NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: ':~:' i'~ ..'.'~; ~' On July 28, 1998 a Conditional Use Permit ("CUP") was issued by the City of Ramsey ("City") to Gerald Bauer ("Permit Holder") for grading operations on the property legally described as follows: The Northeast Quarter of the Northwest Quarter and the Northwest Quarter of the Northeast Quarter of Section 29, Township 32, Range 25, Anoka County, Minnesota, lying north of the Burlington Northern Railroad easement. -and- The south 370 feet of Outlot A, Block 1, Pine Shadows, Anoka County, Minnesota. ("Subject Property:") This permit is issued pursuant to Section 9.03.04 and 9.1.18 of the Ramsey City Code. The conditions of this permit are as follows: 1. This permit shall expire three (3) years fi.om the date of commencement of operations and the Permit Holder shall be responsible for providing the City with at least 48 hours advance notice of the date of commencement of operations. The ingress and egress to the Subject Property shall be from Armstrong Blvd. NW and a private easement across Lot 2, Block 1, IFf-10 Ramsey 2nd Addition. The Permit Holder shall utilize an existing gravel approach at the access point onto Armstrong Blvd. NW to minimize the tracking of grading materials from the site onto the public highway. The Permit Holder shall be responsible for obtaining and complying with any permits deemed necessary from Anoka County. In addition, the Permit Holder shall be responsible for removing any spilled material from the public roads immediately upon direction to do so by the City Engineer. Failure to do so shall be cause for the City Engineer to order the necessary work to be done and billed to the Permit Holder.
